Note 1: Pre-filing search here is limited to search performed on the CANADA Intellectual Property Office's database only.
Note 2: Canada does not allow Multi-class registrations.
Note 3: There are two ways to file a Trademark Registration in Canada: "Intent to Use", or "Actual Use". If currently you are not using your trademark and you don't have a foreign application/registration, then we will file your trademark as "Intent to Use". In this case, we will need to show usage of the mark approximately after 6 months of receiving a Notice of Allowance from the CIPO (this usually occurs about 10 to 18 months after filing). This Statement of Use has a cost of USD450 first class and USD100 per additional class.
Example 1: If you want to apply to have your trademark "ABC" registered in International Class 7 (machines and machine tools etc), that is, one mark one class, the total fees for both trademark pre-filing search and registration request and certificate are:
Intensive Search: USD540 Request for registration: USD1500 Certificate: USD430 TOTAL: USD2470
Example 2: If you want to apply to have your trademark "ABC" registered in International Class 7 (machines and machine tools etc) and International Class 25 (clothing, footwear, headgear), that is, one mark two classes, the total fees for both trademark pre-filing search and registration request and certificate are:
Intensive Search: USD540 + USD400 = USD940 Request for registration: USD1500 + USD500 = USD2000 Certificate: USD430+ USD200 = USD630 TOTAL: USD3570
Example 3 : If you want to apply to have your trademarks "ABC" and "DEF" registered in International Class 7 (machines and machine tools etc), that is, two marks one class, the total fees for both trademark pre-filing searches and registration requests and certificates are:
Search: USD540 + USD540 = USD1080 Request for registration: USD1500 + USD1500 = USD3000 Certificate: USD430 + USD430 = USD860 TOTAL: USD4940
Clients need to provide the following materials:
1. A drawing of the trademark in black and white (size 7 x 7 cm), in case of a design mark. (This can be prepared locally)
2. The list of specific wares and /or services in ordinary commercial terms.
3. Name and Address of the applicant.
4. a. Use in Canada: Date of the first use of the trademark in Canada. b. Intent to use: No further documents are required. (Eventually, in order to obtain registration, a declaration stating that the applicant or its licensees has started using the trademark in Canada must be filed with the Registrar). c. Making known in Canada: Particulars of the distribution or advertising of the trademark will be necessary. d. Foreign use and registration abroad: The date and number of the application /registration and eventually a certified copy of the registration must be filed with the registration.
Note: For convention priority application, information such as the country, the filing date and the number of the application on which priority will be based is required. A certified copy of the basic application is no longer required.
Step by Step Registration Procedures:
Step 1: Clients send to Kaizen (by email or fax or post) a specimen of the trademark, a detailed list of products to be covered by the trademark and at the same time make payment for the pre-filing search (either basic or Intensive search) to Kaizen by remittance or check;
Step 2: Kaizen conduct the pre-filing search and prepare search report and email the search reports to clients;
Step 3: (If the search results indicate that the application is likely to be accepted and clients decide to proceed) Clients send to us the photocopy of identity proof (passport copy for individual and Certificate of Incorporation or Business Registration License) and at the same time make payment for the registration to Kaizen by remittance or check;
Step 4: Kaizen submit the application documents to the CIPO;
Step 5: The Trademark Office perform examination and other procedures; if no objection received, the CIPO then issues the Certificate of Registration;
Step 6: Kaizen forward the Certificate of Registration to clients
Time Scale
Currently it is taking approximately 20-26 months to get a trademark in CANADA.
Period of Protection
15 years. |
